These competition terms and conditions (“Competition conditions”) apply to the “Quiz: Have a chance to win an enchanting overnight stay!” hereafter referred to as: "The Promotion", organised by Efteling BV, with offices at Europalaan 1, Kaatsheuvel, The Netherlands, hereafter referred to as "Efteling".

Article 1 - General details
1.1 Anyone who is a resident of the Netherlands, Belgium, France, Germany or the United Kingdom is eligible to participate in this Promotion.
1.2 If you are under the age of 18, you need to obtain permission from your parents or legal guardian in order to participate in the Promotion. 
1.3 Employees of Efteling and members of their families, as well as third parties retained by Efteling, are excluded from participation. 
1.4 Participation in the promotion is free of charge but subscribing to the Efteling Newsletter is mandatory.  Any costs, of whatever nature, incurred through participation in the Promotion must be borne by the participants.
1.5 By participating in the Promotion, the participant declares that they agree to abide by the conditions of the Promotion and/or those in any way related to these conditions.

Article 2 - Personal details/Privacy statement 
2.1 In order to participate in the Promotion, certain personal data is requested (including name, date of birth, country, visiting frequency and email address).
2.2 You guarantee that all the details you provide are correct, up-to-date and complete. Participants who provide incorrect and/or incomplete details will be excluded from participation and will not be entitled to claim any prizes.
2.3 The details obtained by Efteling in relation to participation in this Promotion will be held in the Efteling data base. These details will be treated with strict confidence, in accordance with the General Data Protection Regulation (GDPR).
2.4 If you are under the age of 18, you first need to obtain permission from your parents or legal guardian. We therefore ask that you do not provide any details until you have first obtained this permission.
2.5 For participants over the age of 18, the details provided can and may be used by Efteling (and its partners, if separate permission has been granted), for other (commercial) purposes, in as much as the participant has given their permission for this.

Article 3 - How and when you can participate 
3.1 The Promotion takes place from Tuesday 14 February until Sunday 19 March 2023 (inclusive). 
3.2 You can participate in the Promotion using the form on efteling.com. You can participate in the Promotion free of charge, by completing the form and by subscribing to the newsletter.
3.3 By successfully completing the game, you have a chance to win a one-night stay at the Efteling Hotel, in a comfort room for up to five people, including breakfast and entry to Efteling Park. Dutch public holidays are excluded.

Article 4 - Announcement of the winners
4.1  A prize winner will be drawn from among the participants who answered the contest correctly. The winner will be notified via email by Friday 31 March 2023 at the latest.
4.2 No correspondence will be entered into in relation to the result of the Promotion.
4.3 If you are among the winners, you hereby grant Efteling permission to make use of your name and/or images in which you are photographed (for example, at the prize presentation), for any press releases or marketing activities regarding this Promotion.

Article 5 - Prizes
5.1 The winner will receive an overnight stay at the Efteling Hotel worth € 592.50.
5.2 All prizes are for individual use only, are non-transferable and cannot be exchanged for cash. If prizes are not claimed or not distributed for any other reason, the prizes revert to Efteling. 
5.3 If the prizes awarded are subject to a gambling tax, this charge will be borne by Efteling.
5.4  Prizes won can be claimed up to 3 months after the closing of the entry period. If the Efteling has not received a response by then, the prize won can no longer be claimed. 

Article 6 - Liability and indemnification 
6.1 Despite the best efforts and care that Efteling takes to ensure the content and functionality of the Promotion website, Efteling cannot rule out the possibility of the site containing incomplete and/or incorrect information. For example, it is not possible for Efteling to screen in advance information/contributions by participants via and/or associated with the Promotion website and/or such information that has been made public.
6.2 Efteling, partner(s) of Efteling and/or any third parties involved with Efteling in the Promotion are not liable for any damages of whatever nature, direct and/or indirect, which may be occasioned by and/or are a result of the Promotion and/or the use of the Promotion website by the participant.
6.3 The participant is fully responsible and liable for their use of the Promotion website, including but not limited to the information/contributions the participant may provide via the Promotion website. The participant fully indemnifies Efteling, their partner(s) and any other third parties that may be retained by Efteling against all possible damages by third parties, of whatever nature, that may be occasioned or be related to the use of the Promotion website by the participant.

Article 7 - Efteling's rights
7.1 Efteling retains the right to terminate your participation in the Promotion at any time, should you act in contravention with these conditions or any legal stipulations, without prior notification, without having to provide any reasons, at their own discretion and without Efteling being held liable.
7.2 Efteling also retains the right to terminate, suspend or change the Promotion at their own discretion and without prior notification, and/or change the prizes of the Promotion, should circumstances so require.
7.3 Efteling expressly retains the right to deny (further) participation by persons (in the interim) and/or to exclude persons (in the interim) from winning prizes without Efteling having to provide any reason.

Article 8 - Use of the Promotion website

8.1 The (intellectual property) rights relating to the Promotion website, including the texts, images, design, databases, photos and other (static and/or moving) images, audio tracks, formats, software, brands (including domain names) and other material, are retained by Efteling and/or one of its licensors.
8.2 The Promotion site may only be used for personal, non-commercial purposes. This means that any other use is not permitted, unless prior, written permission has been granted by Efteling.

Article 10 - Other matters
10.1 These conditions may be amended by us at any time. We therefore recommend that you check the conditions regularly.

10.3 As far as the Netherlands is concerned, this promotion complies with the Code of Conduct for Promotional Games of Chance. As far as Belgium is concerned, this Promotion is regarded as a Free Gambling Game and complies with the applicable regulations.
